Driving Under the Influence (DUI) carries a variety of penalties depending on various factors.

For a blood alcohol level of .08:

  • First offense: lose your license for 6 months, get a mandatory 7 days in jail minimum, up to 60 days maximum and a $500 fine unless you are sentenced to a suspended sentence and probation
  • Second offense: lose your license for 18 months, get a mandatory 30 days in jail minimum, up to 6 months in jail maximum and a $500 fine unless you are sentenced to a suspended sentence and probation
  • Third offense: lose your license for 15 years, get a mandatory 90 days in jail minimum, up to 1 year in jail maximum and a $1000 fine unless you are sentenced to a suspended sentence and probation
  • Fourth offense: lose your license for 15 years, get a mandatory 180 days in jail minimum, up to 5 years in jail maximum and a $10,000 fine unless you are sentenced to a suspended sentence and probation
  • Fifth offense: lose your license for 15 years, get a mandatory 2 years in jail minimum, up to 20 years in jail maximum and a $25,000 fine unless you are sentenced to a suspended sentence and probation

There are even more severe penalties if the blood alcohol content is .15.
